What is a Marital Settlement Agreement vs. a Separation Agreement?

A marital settlement agreement involves a dissolving of a marriage. Part of a marital  settlement agreement can  include distribution of assets, in addition to child custody and visitation rights. Marital settlement agreements are not to be confused with separation agreements.

In a separation agreement, couples may decide to remain married while living in separate homes. Sometimes separation agreements provide a temporary fix to the problems at home, without breaking up the family. When people are contemplating divorce and are not sure if divorce is the next step, a separation agreement will allow the time and space needed to make those difficult decisions; other times, it is the next step before divorce.
