What is a Whistleblower?
Any individual who brings fraud, corruption, waste, or other wrongdoing to light including employees who call attention to these injustices in their workplace is a whistleblower.
Illinois Whistleblower Reward and Protection Act
Enacted in 1991, the Illinois Whistleblower Reward and Protection Act is intended to protect and reward any citizen who reports corruption, including those that report corruption in the government. The law was expanded in 2008 to cover every level of government and specifies that a whistleblower is able to get up to thirty percent of the amount that was recovered as a result of their actions. This money is considered a reward and is not part of any settlement for a retaliation claim.
In many cases, a whistleblower is able to remain anonymous. However, if it is not possible for you to conceal your identity, it is illegal for an employer or an organization to take retaliatory measures including but not limited to demotion, suspension, firing, denial of transfer, or making threats. If this occurs, you may file a retaliation claim. If it is proven that you have been punished as a result of whistleblowing, you may be entitled to compensation such as:
- Back pay;
- Attorneys fees and other costs; and
- Interest on lost wages.
