At Newland & Newland, LLP, our attorneys believe that you have the right to expect that the products you use every day are not only functional but also safe and free from any problems that could result in you getting hurt. If you or a member of your family has been injured, we will work hard to hold the appropriate parties accountable for their negligence and to help you obtain full compensation for your injuries.

Defective and Dangerous Product Representation in Rolling Meadows

On any given day, you probably encounter several thousand different consumer products. Some are intended for convenience purposes while others are meant for fun and recreation. Certain products also are meant to aid in personal hygiene and health-related matters. Sadly, many of the companies that make consumer products tend to put their own bottom line ahead of safety. In an effort to increase profits, they may minimize product safety testing, cut corners in design, and in some cases, knowingly cover up problems of which they are well aware.

Every year in the United States, hundreds of thousands of people seek medical care to address injuries that were caused by defective or dangerous products, such as:

  • Toys for young children, older children, and teens;
  • Children's car seats;
  • Household products such as furniture, appliances, and decorative items;
  • Cleaning supplies and chemicals;
  • Auto parts;
  • Firearms and other weapons;
  • Medical devices, such as replacement joints and pelvic mesh; and
  • Prescription medications.

Types of Product Defects

At Newland & Newland, LLP we understand that there are three basic categories into which a defective product claim might be classified:

  • Design Defects: A design defect is a problem that occurs in the earliest stages of a product's development, and it will affect the entire product line. Product testing is meant to catch design defects before a poorly-designed product reaches the market, but dangerous products are still sold every day. A toy that is marketed to children but that could present a choking hazard might be an example of a product with a design defect.
  • Manufacturing Defects: A manufacturing defect can turn a properly designed and thoroughly tested product into a safety hazard. Such defects occur during production and may be the result of substandard or incorrect materials, counterfeit parts, or a lack of quality control. An example of a manufacturing defect might include workers using a 2" screw in a product that should have had a 2 ½" screw to hold certain pieces together.
  • Failing to Warn: Certain products are always dangerous, no matter how well they are designed or manufactured. Tools for cutting or drilling, for example, have sharp blades or bits that place the user at risk for injury, especially if they are used improperly. The manufacturer is responsible for providing clear user instructions, as well as warnings about the possible dangers related to the product.
