A toy that is marketed to children but that could present a choking hazard might be an example of a product with a design defect.
  • Manufacturing Defects: A manufacturing defect can turn a properly designed and thoroughly tested product into a safety hazard. Such defects occur during production and may be the result of substandard or incorrect materials, counterfeit parts, or a lack of quality control. An example of a manufacturing defect might include workers using a 2" screw in a product that should have had a 2 ½" screw to hold certain pieces together.
  • Failing to Warn: Certain products are always dangerous, no matter how well they are designed or manufactured. Tools for cutting or drilling, for example, have sharp blades or bits that place the user at risk for injury, especially if they are used improperly. The manufacturer is responsible for providing clear user instructions, as well as warnings about the possible dangers related to the product.
